1. Participation in this Canon ‘MegaTank Mega Rewards’ Rebate Program 2024 (Program) is deemed acceptance of these Terms and Conditions (Terms). Instructions on how to participate form part of these Terms.
2. This Program starts at 00.01 am AEDT on 1 January 2024 and ends at 11.59 pm AEDT on 31 January 2025 (Program Period).
3. From time to time during the Program Period, the Promoter may elect to offer additional rebates or incentives to Participants by email in conjunction with this Program. These additional rebates or incentives will be subject to the terms in the email offer and these Terms. To the extent of any inconsistency, these Terms will prevail.
Definitions
4. In these Terms:
Dynamic Supplies means Dynamic Supplies Pty Ltd ABN 25 064 793 862.
Eligible Products means the new (not second-hand or refurbished) Canon MegaTank product models listed in clause 10 below. Canon products purchased from any source other than Canon Australia’s official distribution channel (including ‘grey’, ‘parallel’ or ‘direct’ imports) are ineligible for this Program.
Eligible Reseller means an authorised Canon reseller in Australia who has purchased Eligible Products from Dynamic Supplies.
Promoter means Canon Australia Pty Ltd (ABN 66 005 002 951) of Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, Australia (Phone: 13 23 53).
Rebate Value means the rebate value listed in clause 10
below.
Eligibility
5. This Program is only open to Eligible Resellers who accept an email invitation from Dynamic Supplies (Invitation) to participate in this Program (Participants).
6. Participants must follow the instructions in the Invitation to set up an account on the portal via the link emailed (Portal).
7. Participants who sign up to this Program consent to Dynamic Supplies providing fortnightly reports to the Promoter with sufficient detail for the Promoter to determine and verify the Rebate Value payable to each Participant (Reports).
8. The Promoter will review the Reports and update the Portal with the Rebate Value payable to each Participant.
9. The Rebate Value is based solely on the Reports and the Promoter has no control over and is not responsible for any discrepancy in the Reports.
Rebates for Eligible Products
10. The Promoter will pay each Participant the Rebate Value that corresponds with each Eligible Product purchased by the Participant as follows:

(b) The Promotor reserves the right to make amendments to the list of Eligible Products and Rebate Values with 30 days notice to Participants via email. Terms will be accordingly deemed to be amended to include the updated Rebate Values and Eligible Products applicable.
11. In addition to the Rebate Value payable for each Eligible Product, the Promoter will pay Participants an amount of $500 for every 25 units of Eligible Products purchased during the Program Period.
How to Claim
12. To claim the Rebate Value, Participants must log into the Portal and choose to either transfer the available Rebate Value directly to their specified bank account in Australia, or to receive the Rebate Value through a digital Visa gift card (Digital Gift Card) (Claim).
13. Rebate Values paid out in Digital Gift Cards are subject to Visa’s terms and conditions at: https://truerewards.com.au/visa-gift-card terms.
14. Digital Gift Cards must be activated within 6 months of receipt and will be valid for a period of 12 months from the date of production. After this period, the Digital Gift Card will no longer be valid. Participants have no right to receive a refund of any unused value remaining and that unused value will become iGoDirect’s property immediately following the expiry date.
15. The minimum Rebate Value that can be claimed is $250. Rebate Value amounting to less than $250 may be claimed from the last day of this Program.
16. No responsibility is accepted for any Claim that is late, lost or misdirected, or if a Participant does not claim their Rebate Value in accordance with these Terms.
17. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays, delays in bank processing or Portal downtime.
18. Participants must make a Claim for their Rebate Value by 30 April 2025. The Promoter will not compensate any Participant in any way for Rebate Value that has not been claimed by 30 April 2025.
Conditions that may invalidate a Claim or disqualify a Participant
19. The Promoter reserves the right, at any time, to verify the eligibility of Participants and the validity of a Claim, invalidate any Claim that is not in accordance with these terms, or disqualify any Participant who tampers with this Program.
20. Participants must provide any information or records reasonably requested by the Promoter for the purpose of auditing the validity of any Claim.
21. A Participant forfeits their right to make a Claim for any Eligible Product that is subsequently returned or refunded for a change of mind.
22. If a Participant receives any Rebate Value and subsequently returns or refunds the relevant Eligible Product, the Promoter may invoice the Participant for the Rebate Value, which must be paid by the Participant to the Promoter within 7 days of receiving the invoice. The Promoter reserves the right to take appropriate action where the Participant does not pay the invoice.
23. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s decisions are final and no correspondence will be entered into.
24. If this Program is interfered with in any way (including any Participant returning for refund any Eligible Products in a manner which violates the spirit of this Program, as determined by the Promoter in its sole discretion), or is not capable of being conducted as anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a. disqualify any Participant;
b. cancel any Rebate Value issued; or
c. modify, suspend, terminate or cancel the Program as appropriate.
25. If a Participant is disqualified from this Program, they will only be eligible to Claim the Rebate Value for Eligible Products purchased prior to the date that they are disqualified from this Program.
Privacy
26. The Promoter collects personal information in order to conduct this Program. The Promoter may, for the purpose of conducting this Program, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
27. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy).
28. These Terms may change and the Promoter will inform Participants of any changes as soon as reasonably possible.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investment Commission Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
30. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, consequential, incidental, punitive or exemplary, arising in any way out of the Program including: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any Claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; and (d) any tax liability incurred by a Participant.
31. All money amounts in these Terms are in Australian Dollars inclusive of GST.
32. The Promoter may accept errors and omissions at its discretion and its failure to enforce any of its rights is not a waiver of those rights.
33. If any provision of these terms is unenforceable for any reason, such provision shall be severed from these terms and the remaining terms will remain in full force and effect.
34. These terms are governed by the laws in New South Wales. All Entrants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
